The Privacy and Cookies Policy (the Policy) determine how UAB Techzity (the Company or we) handles its customers, visitors of the website www.techzity.com (hereinafter – the Website), users of the Pingin Mobile App (the App), and personal data of other persons (You, Customers or visitors).

The controller of your personal data is UAB Techzity, legal entity code 304111823, registered office address Paribio str. 12, LT-08101 Vilnius, the Republic of Lithuania.

It is important that you read the Policy carefully, as each time you visit the Website, use the App or provide it with your personal information, you acknowledge that you have read the terms and conditions described in this Policy. If you do not agree to these terms, please do not visit our website, use our content and/or services or provide us with your personal information.

The terms used in the Policy are as defined in the EU General Data Protection Regulation no. 2016/679 (GDPR).
1. DEFINITIONS

• The Company or we – UAB Techzity, legal entity code: 304111823, registered office address: Paribio str. 12, LT-08101 Vilnius, the Republic of Lithuania.
• Customer or you – a natural person at least 18 years of age who has agreed to the Rules and has created an Account.
• The Website – [the website www.techzity.com].
• Account – a password-protected personal Customer account created during registration on the Techzity website [or mobile app], to which the Customer can, inter alia, update their data, purchase Credits and view their balance, order (reserve) Techzity Services and Products, to get acquainted with the instructions and procedures for using the Services and Products, to find other relevant information, to see the news or notifications of the cooperation area, to contact the Company’s contact persons, to report any breakdowns at Techzity premises, etc.
• Rules – the rules for using Techzity services, which are published on the Techzity website and in the App.
• Techzity mobile app or the App – is an application software for smartphones, tablets, and other mobile devices that allows Customers to access, subscribe to, and use the Services and Products.
• Membership – a paid virtual Techzity membership that is acquired by registering on the Techzity website (i.e., by creating an Account) and providing access to and use of the Services and Products.
• Services and Products – the Company’s services and products that are available on the Website (the solutions)
2. HOW DO WE COLLECT YOUR DATA?
The Company collects and processes personal data in accordance with the legal acts of the European Union and the Republic of Lithuania regulating the protection of personal data.
The Company processes the personal data of the Customers on the following basis:
• On the basis of consent, which is expressed in your active actions, i. y. contacting us and providing personal data, registering to receive newsletters, agreeing to the cookies, using the App – separate consents in the App or other active actions;
• Concluding, executing, administering, amending purchase-sale contracts, workplace lease agreements, Service and Product provision agreements, or similar documents;
• For the implementation of the legitimate interests of the Company and/or third parties (e.g., administering the Website, the App and ensuring its proper functioning by ensuring the quality of the provided Services and Products and the security of the assets managed by the Company, in order to prevent violations of the law, fraud in the use of our Services and Products, to defend against claims or to defend our rights, the collection, and analysis of statistical data, market analysis, etc.);
• In order to fulfill our obligations under the law.
3. PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF REGISTRATION, IDENTIFICATION, AND PROVISION OF SERVICES AND PRODUCTS ON THE SITE
After you create an Account on the Website and/or in the App, the Company processes the following personal data of you: name, surname, e-mail address, phone number, encrypted password, links to social networking accounts on Facebook and LinkedIn (if you prefer to submit).
Registration on the Website and/or in the App with the consent of the Rules is an agreement between you and the Company on the basis of which we process the said personal data.
The Company will retain this personal information until you delete the Account you have created or to the extent necessary to achieve the purposes for which they are processed, as well as in accordance with the requirements for such data retention set forth in the legislation, periods of limitation for the purpose of bringing or defending legal claims and, if any, to the extent necessary for that purpose. If the Customer decides to delete the Account, the Account data will be stored for 6 months, during which the Customer will be able to apply for reactivation of the Account. After this period, the data will be permanently deleted and the Customer wishing to continue using the Company’s Services and Products will need to create a new Account.
4. PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF ELECTRONIC COMMERCE AND THE PROVISION OF SERVICES
The Company processes your personal data for the purpose of e-commerce in order to process the orders placed on the Website, as well as:
• to conclude and execute agreements on the Services and Products provided by the Company;
• to issue invoices and other documents;
• to carry out accounting;
• to perform statistical procurement analysis in the Company’s e-shop;
• to administer issues related to the provision of Products and/or Services provided by the Company;
• to administer the Website, the App, and the Customer’s Account;
• to issue a pass card and link it to the Customer’s Account;
• managing access to/from the Company’s premises;
• providing other services, such as the rental of meeting rooms or equipment owned by the Company.
For these purposes, the Company processes the following personal data on the basis of the performance of the agreement with the Customer: name, surname, telephone number, e-mail address, details of the Services and Products purchased on the Website and/or the App, credits, memberships purchased and/or other Services (e.g., date, time, name, amount of credits, memberships purchased and/or other Services, etc.), payment details (bank account number, payment method, etc.). If the purchase-sale, service, or workplace lease agreement with the Company is concluded by a natural person engaged in economic activity (entrepreneur) and wishes to receive a VAT invoice, we may additionally request the personal identification code, VAT payer’s code, and address of activity or residence.
We receive the above data from the Customer himself when placing an order to purchase the Services or Products and using the services, as well as from the payment service providers, the Customer successfully completing the payment for the Products and Services.
When the Client uses the Services and Products provided by the Company – when entering the co-working premises, using meeting room reservation, printers, and other equipment, the Company will collect information about the use of the Services and Products – entry/exit time, information about meeting room reservation, use of the Company’s equipment.
In the event that the Customer acquires credits, memberships, or other Services and Products by registering and logging in to their Account on the Website and/or the App, the Company will link the personal data mentioned above to the Customer’s Account. If the Customer deletes the Account, the data would be stored separately as concluded agreements.
Based on the legitimate interest of the Company, we may also process the data mentioned above in order to improve the Services and Products provided by the Company, perform statistical analysis of the best-selling members and otherwise improve the Company’s operations.
The Company retains this personal data to the extent necessary to achieve the purposes for which they are processed, as well as in accordance with the requirements for such data retention set forth in the legislation (e.g., sales contracts are retained for 10 years, issued invoices – for 8 years), periods of limitation for the purpose of bringing or defending legal claims and, if any, to the extent necessary for that purpose. If the Customer decides to delete the Account, the Account data will be stored for 6 months, during which the Customer will be able to apply for reactivation of the account. After this period, the data will be permanently deleted and the Customer wishing to continue using the Company’s Services and Products will need to create a new Account.
5. PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF DIRECT MARKETING
For the purpose of direct marketing, in order to provide newsletters, offers, and information about the Company’s Products and/or Services, the Company processes the following personal data of you: name, surname, telephone number (if provided), e-mail address. If you have created an Account on the Website and wish to receive personalized offers customized to you, we will also process information about the Products, memberships, and/or other Services ordered on the Website and/or in the App (e.g., date, time, name, the quantity of the ordered Services, etc.), history of personal offers submitted, and information about their use (profiling for direct marketing purposes).
Your personal data may be processed for the purposes of direct marketing in the following ways:
• You can receive a newsletter with offers and news from us and our partners by e-mail or SMS;
• You may receive a request by e-mail or SMS to provide feedback on the Services and/or Products provided to you by us or our partners, affiliates, and companies of the Company group.
You may opt out of our direct marketing communications at any time. You can do this by clicking on the link at the bottom of the messages we send, informing us via e-mail info@techzity.com or by phone +370 648 41 505.
We may work with third parties, such as online advertising developers and advertising exchanges to advertise online, and we may work with third-party analytical service providers to help evaluate and provide us and/or third parties with information about the use of such advertisements on third-party sites and ads and reviews of our content.
Data about your online activities may be collected so that we or third parties can later display content that is relevant to your individual interests (see the Cookies Policy section for more information).
Personal data will be processed for direct marketing purposes [for 5 years] from the date of receipt of the consent to process the data for this purpose, unless the Customer revokes the consent earlier.
6. PROCESSING OF PERSONAL DATA FOR THE PURPOSE OF ADMINISTRATION OF REQUESTS
The Company processes your personal data when you submit a request and/or complaint to it by email, mail, or telephone.
The company processes your personal data in the following cases:
• To ensure the quality of the Services and Products we provide in order to administer requests and/or complaints;
• Based on your consent, which you express by your active actions in submitting a request and/or complaint.
The Company will protect the personal data provided by you in order to administer requests and/or complaints, ensure the quality of its Services and Products, to the extent necessary to examine and respond to your request and/or complaint, as well as in accordance with the requirements for the storage of such documents laid down in the legislation, during the limitation periods for bringing or defending legal claims and, if any, to the extent necessary for that purpose.
7. PROCESSING OF PERSONAL DATA OF THE COMPANY’S CONTRAHENTS
The Company handles the personal data of different categories of data subjects (e.g., companies concluding a workplace lease, business partners, suppliers, counterparties, as well as their employees, representatives and agents, and other persons visiting the Company). The following data (name, place of work, position, contact information in the case of a workplace lease – information on employees entitled to use the workplace) are collected and processed for the following purposes and basis:
• In establishing, maintaining, and developing business, professional, or other legal relations with the Company;
• Concluding, executing, administering transactions, contracts, and agreements;
• Developing and ensuring the legitimate interests of the Company;
• Defending the Company against lawsuits, requirements, and claims brought against it;
• In the performance of the Company’s duties under applicable legitimate.
The Company retains the personal data of persons to the extent necessary required by the contract, business relationship or to the extent necessary to achieve the purposes for which they are processed, as well as in accordance with the requirements for the storage of such documents laid down in the legislation, ​during the limitation periods for bringing or defending legal claims and, if any, to the extent necessary for that purpose.
8. PROCESSING OF PERSONAL DATA ON THE WEBSITE
In the event that you visit our Website, the Company may process the visitor’s IP address, network, and location data when the visitor provides it. Data is collected using cookies and other similar technologies with the consent of users.

10. DATA PROCESSORS AND OTHER DATA RECIPIENTS
The Company uses certain service providers (data processors) to process your personal data.
Such data processors are: data processing service providers, data center service companies, internet browsing or internet activity analysis and service companies, software creation, provisioning, support and development companies, accounting services companies, information technology infrastructure service companies, communication, security, call service companies and other service providers to whom your personal data is disclosed only to the extent necessary for the provision of their services.
When using the ability to connect to the Website and/or App through Facebook or LinkedIn social network accounts, information about the creation of the Account will be provided to social network administrators to ensure proper connection to the Website and/or App.
If there is a sufficient legal basis (e.g., when it is necessary for concluding or executing a contract with you and when you have been informed about such transfer), the data may be transferred to our business partners, contractors, owners of the premises used by Techzity.
When making a payment, certain personal data about the order, the method of payment, the identity of the customer will be transferred to the service provider processing the payment (e.g. Paysera) in accordance with the terms and conditions of this service provider and legal requirements.
We must pass on your personal data to the national supervisory authorities on the grounds and in the cases provided for by legislation.
With the exceptions listed below, we process your personal data in the European Union. We do not currently intend to transfer or we do not transfer your personal data to third countries.

To ensure the proper level of data security and to guarantee the lawful transfer of data, we create the Standard Terms and Conditions approved by the European Commission or follow other terms and conditions established by the GDPR.
Your personal data may only be provided to other data recipients on the grounds specified by legislation.
11. DATA RETENTION PERIOD
Retention of your personal data for longer than specified above may take place when:
It is necessary for the Company to be able to defend itself against claims or lawsuits and exercise its rights;
There are reasonable grounds for suspecting illegal activity which is the subject of an investigation;
Your data is necessary for the proper resolution of a dispute or complaint;
Backups and other purposes related to the operation and maintenance of information systems or for similar purposes;
In other cases provided for in the legislation.
12. YOUR RIGHTS IN THE FIELD OF PROTECTION OF PERSONAL DATA
To the extent and under the conditions laid down by the legislation applicable to your personal data, you have the following rights:
• Get acquainted with your personal data and how they are processed;
• Require the correction of incorrect, inaccurate, or incomplete data;
• Require the deletion of your personal data or restrict the processing of your personal data when personal data are processed in breach of legal requirements or when there is another legal basis;
• Require the transfer of your personal data to another data controller or provide it directly in a form convenient for you (applies to those personal data which you have provided and which are processed by automated means on the basis of a contract or consent);
• The right to object to the processing of your personal data if it is processed on the basis of legitimate interest unless there are legitimate reasons for such processing or to make, enforce or defend legal claims;
• The right to withdraw consent at any time if your personal data is processed on the basis of consent.
In cases when you believe that your personal data is being processed illegally or your rights related to data processing are being violated, you have the right to contact the State Data Protection Inspectorate (for more information, visit www.vdai.lrv.lt) and submit a complaint to it.
The Company recommends that you contact the Company by email info@techzity.com to find the right solution to your problem before submitting a formal complaint.

How to exercise your rights?

In order to exercise the above rights, the Customer must submit the completed request to the Company in person, by mail, through a representative, or by electronic means. The request must be legible, signed, and must include the Customer’s name, place of residence, contact information and information on the reason, what rights and to what extent it is wanted to exercise, and information on how to receive a response.
The Company has the right to verify the identity of the applicant when executing the Customer’s request. At the request of the Company, if the request is submitted directly, the Customer must provide an identity document to the Company’s employee responsible for servicing persons. If the application is submitted by mail, a copy of the identity document certified in accordance with the procedure established by legal acts must be submitted together with the application;
Upon receipt of your request and successful verification of your identity, the Company will provide you with information on the action have taken in response to your request no later than one month after receiving your request and completing the verification process. Depending on the complexity and number of requests, the Company has the right to extend the one-month period for another two months, notifying you no later than one month after receiving your request and completing the verification procedure, stating the reasons for such extension.
When exercising the Customer rights related to personal data, the Company:
• has the right to ask the Customer to specify the submitted request;
• Provides information to the Customer to the extent that ensures that the rights of other persons are not violated if certain information about the Customer is related to other persons as well.
The Company has the right to refuse to fulfill your request on the grounds and (or) the circumstances established by legal acts and will inform you about it in writing, giving the reasons for such refusal.

14. OTHER PROVISIONS
The Company may update the Policy at any time. The Company will notify Customers of updates by posting a new version of the Policy on the Website with the date of the most recent change. Customers understand that by continuing to use this website after the Policy has been updated, they agree to the changes made.
If any provision of the Policy is held to be invalid or unenforceable, that provision will not affect the legality and enforceability of the remaining provisions of the Policy.
The Policy is applicable from the date of its publication on the Company’s website and/or in the App.
